Conduct: Mr Michael Doohan failed to ensure that London Formwork Limited (‘London Formwork’), made payments in full, as and when due, to H M Revenue and Customs (‘HMRC’) in respect of VAT and CIS/NIC, and caused London Formwork to trade to the detriment of HMRC from 07 March 2020 to 07 May 2022 resulting in total liabilities owed to HMRC, the majority creditor at liquidation, of £599,379 inclusive of charges and interest. In that: • Between the periods ending January 2020 and April 2022 London Formwork incurred VAT liabilities of £429,510, based on returns submitted to and assessments raised by HMRC, inclusive of surcharges and penalties. The last payment the company made in respect of VAT was on 26 February 2020 for £50,000, which paid VAT periods ending October 2019 and January 2020. • For tax year ending April 2020, London Formwork owed CIS and NIC liabilities totalling £548,550. London Formwork made payments totalling £485,048. The last payment was made on 20 March 2022 and relates to the tax year 2019/2020. HMRC have submitted a claim for outstanding CIS and NIC liabilities owed by London Formwork of £63,502 for CIS £62,574 and NIC £928. • For tax year ending April 2021, HMRC have submitted claims for outstanding CIS and NIC liabilities owed by London Formwork totalling £106,367 for CIS £105,551 and NIC £816. London Formwork made no payments towards this tax year. • Statements for London Formwork’s bank account for the period 07 March 2020 to 7 May 2022 record payments into the account totalling £1,348,487 and debits from the account totalling £1,294,976. In the same period, HMRC received payments totalling £60,417 for PAYE/NIC and £309,400 was paid to the two directors. • HMRC have claimed £702,836 in London Formwork’s liquidation in respect of VAT, PAYE, NIC, penalties and interest. Other creditors are the bank for £50,000 and directors for £240,000. The liquidator has only received a Proof of Debt from HMRC.
