Conduct: Mr Aliaj caused Heswall to apply for and obtain a BBL in the sum of £50,000 using an overstated turnover figure on the BBL application form when he knew or ought to have known that Heswall was not entitled to receive this sum and that he failed to use the BBL funds for the economic benefit of Heswall as required under the terms of the BBL scheme in that Turnover / entitlement 10.1 The BBL Scheme permitted a loan of up to 25% of a business’ turnover in the calendar year 2019, subject to a maximum of £50,000, and required that the funds be used for the economic benefit of the business. 10.2 Heswall was incorporated on 22 September 2014. 10.3 Bank analysis shows that Heswall’s bank receipts totalled £74,970 for the calendar year 2019. 10.4 Mr Aliaj applied for a £50,000 BBL, declaring that Heswall’s annual turnover was £200,000. 10.5 As a result of that overstatement, Heswall obtained £31,258 more than it was entitled to under the BBL Scheme. 10.6 In making the BBL application, Mr Aliaj knew or at the very least ought reasonably to have known, that the amount applied for and obtained exceeded that to which Heswall was properly entitled. Use of funds 10.8 On 13 May 2020, £50,000 in BBL funds was paid into Heswall’s bank account. At that time, the account was £2,284 in credit. 10.9 On 26 June 2020 £50,000 was transferred to Mr Aliaj’s personal bank account. 10.10 Between 13 May 2020 and 26 June 2020, no trading income was received into Heswall’s bank account. 10.11 Mr Aliaj has failed to provide any evidence, despite requests, demonstrating that the BBL funds were applied for the economic benefit of Heswall. 10.12 In causing that transfer, and having regard to the terms of the BBL Scheme, Mr Aliaj knew, or at the very least ought reasonably to have known that the BBL funds were not being used in accordance with the terms of the BBL Scheme. Loss and outcome 10.13 Heswall made repayments of £8,581 in respect of the BBL. 10.14 Heswall entered Creditors’ Voluntary Liquidation on 18 August 2023. 10.15 A claim has been submitted in the liquidation in the sum of £41,972 in respect of the BBL from the bank.
