Conduct: Adam Clayton (“Mr Clayton”) breached the terms of the Bounce Back Loan (BBL) scheme by causing All Secure Contracts Limited (ASC) to overstate its turnover and make two applications for BBLs. As a result, ASC received BBLs totalling £50,000 when Mr Clayton knew or ought to have known that ASC was not eligible for loans of that amount, in that: • Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019 or where a business was established after 1 January 2019 it is their estimated turnover from when the company started. • ASC was incorporated on 03 September 2014. • On 04 May 2020, Mr Clayton applied for a BBL of £20,000 on behalf of ASC with bank A, declaring a turnover of £86,000 • On 04 May 2020, ASC received a BBL of £20,000 from bank A. • On 22 June 2020 Mr Clayton applied for a BBL of £30,000 on behalf of ASC with bank B, declaring a turnover of £240,000. • Applicants were required to declare that the BBL application they were completing was the company’s only application. • On 22 June 2020, ASC received a BBL of £30,000 from bank B. • ASC’s Year End 30 September 2019 accounts show turnover of £28,720 • ASC’s Year End 30 September 2020 accounts show no turnover. • Based on ASC’s accounts to 30 September 2020, the company would have been entitled to a BBL of no more than £7,180. Meaning that ASC received at least £42,820 more than it was entitled to from the BBL scheme. • ASC entered Creditors’ Voluntary Liquidation on 19 June 2023. • Total liabilities at liquidation amount to £60,940 of which £51,122 relates to the amount owed in respect of the BBLs.
