Conduct: Anthony Engleman (“Mr Engleman”) caused Tanmon Limited to operate to the detriment of HMRC from start of trading in March 2014 until the date of the winding up order. In the period he failed to register Tanmon for Value Added Tax (“VAT”), despite the turnover being substantially in excess of the threshold for registration and failed to file any returns or make any payments after the company was registered for VAT on 31 March 2016 with effect from 24 March 2014. As a result, HM Revenue & Customs (“HMRC”) are owed £660,051 at the date of liquidation in respect of VAT. In that:-

  • Incomplete Sage records for the period from 01 April 2014 to 31 March 2015 show the company had turnover of £240,941.59.
  • Information provided by HMRC for the period between June 2014 and December 2015 in respect of merchant data show company turnover of £547,470. HMRC then used this as the basis to issue an assessment for VAT from 03/14 to 05/16 of £498,610.
  • The company only registered for VAT on 31 March 2016 which was backdated by HMRC to be effective from 24 March 2014. No VAT returns were filed for any periods.
  • The company also failed to submit any PAYE/NIC returns has caused HMRC to issue a Reg 80 assessment of £152,000 Comparative application of company income
  • Analysis of the bank statements for the period 1 June 2014 and 31 October 2015 show that £587,183.73 was received and £618,561.20 was expended from the company’s bank account. The Official Receiver is not in receipt of bank statements after this period.
  • An analysis of the payments made show £96,300 was paid to the director or to his benefit. A further £76,480 was made in cash withdrawals. In the same period HMRC received no payments at all
  • At the date of liquidation HMRC has a claim of £812,051 and the only other known creditor is an associated company owed £304,000.
