Conduct: On 18 June 2020, Philip Joseph Bartlett (“Mr Bartlett”) ”) breached the terms of the Bounce Back Loan (“BBL”) scheme by causing caused PJB Building and Carpentry Limited (“PJB”) to make a Bounce Back Loan (“BBL”) application of £50,000 when he knew or ought to have known that PJB was not eligible for the loan under the terms of the BBL scheme. Furthermore, Mr Bartlett failed to ensure that the proceeds of the BBL were used in their entirety for the economic benefit of PJB, in that: • The Bounce Back Loan eligibility criteria was that a business had to be carrying on business on 1 March 2020, engaged in trading or commercial activity in the UK at the date of the application and had been adversely affected by coronavirus (COVID-19). The information provided was self-certified by the applicant. The loan was to be used to provide economic benefit to the company, wholly for business purposes and not personal purposes. • PJB was incorporated on 07 March 2014. PJB filed dormant accounts for the periods ending March 31, 2019 (approved by Mr Bartlett on 28/12/19), March 2021 and March 2022. • Between 09 December 2018 and 17 June 2020, analysis of the PJB’s bank statements show credits totalling of £100. The balance on the bank account prior to receipt of the BBL funds was £74. • On 18 June 2020, Mr Bartlett applied for a BBL on behalf of PJB. He stated on the application form that PJB had a turnover of £280,000. • On 18 June 2020, PJB received a BBL of £50,000. PJB was not eligible for a BBL of any amount given it was not carrying on business on 01 March 2020 or engaged in in trading or commercial activity at the time of the BBL application. • Between 18 June 2020 and 15 August 2021, Mr Bartlett received £53,037 from PJB’s bank account, of which £50,000 was from the BBL funds. • Total liabilities at Liquidation on 11 January 2024, amount to £58,820 of which at least £48,710 relates to the amount owed in respect of the BBL. Mr Bartlett did not disclose the BBL liability on the Statement of Affairs.
