Conduct: From at least 8 January 2020, Abdul Ullah (“Mr Ullah”), caused Amzan Limited (“Amzan”) to trade to the detriment of Her Majesty’s Revenue and Customs (“HMRC”) in respect of Value Added Tax (“VAT”), resulting liabilities of £232,613 at the date of liquidation, inclusive of VAT surcharges. VAT • Amzan was registered for VAT on 22 February 2017, at this time, Mr Ullah was director. • Mr Ullah was appointed as director from 11 February 2014 to 24 April 2017. Mr Ullah was reappointed on 15 May 2019 until liquidation. • Mr Ullah has confirmed he was aware of the requirement to submit VAT returns and make payment to HMRC. • Amzan failed to submit any VAT returns from quarter ending 30 November 2019 to the quarter ending 31 May 2022. • In the absence of VAT returns HMRC raised assessments for period of quarter ending 30 November 2019 to the quarter ending 31 May 2022 inclusive of surcharges totalling £232,613. • This has been calculated by the non-payment of the following quarters;- 1. VAT on return 30 November 2019 totalling £8,661. 2. VAT prime/auto assessment from 29 February 2020 to 31 May 2022 totalling £199,098. 3. VAT surcharges from 30 November 2020 to 31 May 2022 totalling £24,853. • Bank analysis shows this between 1 January 2020 and 30 January 2023, one payment of £1508 was paid to HMRC on 13 February 2020. Comparative Treatment • During the period 8 Jan 2020 to 31 January 2023, a total of £ 1,174,703 was paid into the company bank account. A total of £1,175,643 was paid out of which £ 1,508 was paid to HMRC • HMRC have submitted a claim in liquidation with a total liability of £314,178.
