Conduct: From 07 November 2014 at the latest, Quintin Dawson (“Mr Dawson”) caused F&G@DEPTW Ltd (“F&G”) to trade to the detriment of HM Revenue and Customs (“HMRC”) in breach of its statutory obligations by failing to ensure that returns and payments were submitted to HMRC in respect of VAT and PAYE/NIC during his appointment as director and as a result HMRC have submitted a claim of £127,277.02. In that: ? VAT returns for the periods June 2014 to June 2016 were submitted late and without payment and resulted in surcharges being incurred. Only the September 2016 VAT return was submitted on time, however without full payment. No return was submitted for December 2016. ? Assessments for the periods September 2014 to March 2015 had been paid, however the assessments were less than the actual VAT return amounts. ? HMRC’s records show that only payments totalling £10,726 were made with regards to VAT. HMRC have submitted a claim of £51,532 in respect of VAT. ? HMRC’s records show that RTI returns for PAYE/ NIC were submitted from April 2014 to February 2017 and that no full payments were made in respect of the returns submitted between April 2014 and February 2017. HMRC have submitted a claim of £75,745 in respect of PAYE and NIC. ? He agreed a time to pay arrangement with HMRC in May 2015, which he defaulted with shortly after. Another time to pay arrangement with HMRC was commenced in November 2015, which he also defaulted with shortly after. The last time to pay arrangement with HMRC was commenced in October 2016, which he also defaulted with shortly after. ? Following liquidation trade creditors were owed £17,906 leaving HMRC as the majority creditor, being owed £127,277. Bank analysis shows that between April 2015 and February 2017, £1,374,750 was received into F&G’s bank account in respect of sales, of which £54,400 was paid to HMRC.
