Conduct: Michael David Watkins (“Mr Watkins”) as the sole registered director of Falconer Services (Birmingham) Limited (FSBL) caused FSBL to trade to the detriment of HM Revenue and Customs (“HMRC”) in respect of its Construction Industry Scheme (“CIS”) tax liabilities from 23 March 2016 (when the part liability for the tax month ended 05 March 2016 fell overdue for payment in full) until FSBL was placed into liquidation on 03 May 2018. 1) FSBL submitted CIS monthly returns to HMRC for the tax years 2015/2016 (£10,715), 2016/2017(£32,762), 2017/2018 (£61,349), disclosing CIS tax liabilities totalling £104,826 due to HMRC; 2) Between 15 December 2015 and 13 April 2017 HMRC allocated payments totalling £20,481 towards the CIS tax liabilities for the tax years 2015/2016 (£8,890) and 2016/2017(£11,591); 3) At the date of liquidation FSBL’s CIS tax liabilities payable prior to the date of liquidation amounted to at least £85,462 comprising of CIS tax liabilities of £84,345, penalties of £700 and interest of £417. The oldest part of the CIS tax liability of £411 was for the tax month ended 05 March 2016 which fell overdue for payment in full to HMRC on 23 March 2016.) In the period from 30 November 2016 to 29 September 2017 £659,024 (includes bank charges and interest) was expended from FSBL’s bank account to various parties including Mr Watkins. Whilst over the same period £11,443 was paid to HMRC in respect of its CIS tax liabilities.
