Conduct: Altaf Dawood Patel (“Mr Patel”), caused Factory Clearance (“FC”) to enter into transactions to the detriment of the general body of creditors contributing to the increased insolvency of the company, during the period 22nd February 2016 to 06 April 2016 specifically:-

  • On 03 February 2016 notice of the Liability Order, to be heard in Bury & Rochdale Magistrates Court was served on him. This liability was for non payment of Business Rates for company premises in Bury from 05 December 2014 onwards totalling £67,460. He acknowledges, FC was unable to satisfy this debt and was insolvent but continued to trade.
  • On 22 February 2016 a £65,000 loan was received into the company’s bank account. He accepts that he took the loan out at a time when the company was at risk of failure.
  • In the period 26 February 2016 to 06 April 2016, he withdrew £59,300 from FC, without deduction of tax, comprising a combination of private cash payments out of the company’s bank account and transfers to his personal bank account.
  • FC ceased to trade in April 2016 and was eventually wound up on the petition of Preston County Council on 3 April 2017.
