Conduct: From at least 7th January 2016 to 31st December 2016, the date of your resignation as a director, Mr Menekse failed to ensure that Rax submitted timely VAT returns and to settle all its HMRC liabilities as and when due and caused Rax to trade to the detriment of HMRC from that date. In that: - a. Returns for the VAT periods ending 30th November 2015 and 28th February 2016 were submitted by up to 10 months late whilst those for the periods ending 31st May 2016 and 31st August 2016 were not submitted by the date of your resignation on 31st December 2016; b. The return accrued liability of £19,152.67 for the VAT period ending 30th November 2015 should have been settled in full by 7th January 2016 at the latest. A total of £10,567.67 remaining outstanding; c. Rax also failed to settle in full all its return accrued liabilities totalling £49,231.66 incurred in the next three VAT periods ending 28th February 2016 to 31st August 2016, leaving £46,081.66 outstanding; d. Rax’s VAT liability was therefore outstanding from at least 7th January 2016. e. HMRC submitted a claim in the liquidation for £9,209.65 in respect of Corporation Tax for the periods ending 01.10.14 to 30.09.15 and 01.10.15 to 30.11.15, RTI interest and RTI PAYE/NIC for the 2015/16 and 2016/17 tax years and further interest; f. The available bank statements show that between 7th January 2016 and 30th December 2016, sums totalling at least £405,686.93 were paid from the bank account of which £4,726.36 was listed as being paid to HMRC. However, according to the information provided by HMRC payments totalling at least £20,251.85 were made by Rax to HMRC between 16th April 2016 and 15th December 2016. At least £385,494.98 was utilised to pay trade creditors, wages and other operational costs
