Conduct: Miss Alice Horlick (“Miss Horlick”) caused Aevha London Limited (“Aevha”) to breach the terms and conditions of the government-backed Bounce Back Loan (“BBL”) scheme by providing information which she knew or ought to have known was false in an application to obtain a BBL of £50,000. This resulted in Aevha receiving £40,043.60 more than it was entitled to under the BBL scheme. In that: • Under the BBL scheme rules, a company that was carrying on business on 01 March 2020 and was impacted by the Covid-19 pandemic could apply for a BBL of between £2,000 and £50,000, up to a maximum of 25% of its 2019 calendar year turnover. When making an application for a BBL, an application had to self-certify the company’s 2019 calendar year turnover and be engaged in trading or commercial activity at the date of the application. • Aevha was incorporated and commenced trading on 23 September 2013, and as Aevha was trading before 01 January 2019 was therefore required to provide turnover for the calendar year 2019 in the BBL application • Aevha’s Management Accounts prepared by Miss Horlick for the year ended 31 December 2019 show turnover was £39,825.61. • On 06 May 2020, Miss Horlick applied for a BBL of £50,000 and declared Aevha’s 2019 calendar year turnover to be £200,000. • Based upon the turnover in Aevha’s Management Accounts prepared by Miss Horlick for the year ended 31 December 2019 (£39,825.61), the Company would have been eligible for one BBL of £9,956.40. Miss Horlick therefore overstated Aevha’s turnover on its BBL application, causing it to receive £40,043.60 in BBL funds more than it was entitled to. • The BBL remains outstanding, and the BBL lender has claimed £45,153.26 in Aevha’s liquidation.
