Conduct: Chris Mulkerrins (“Mr Mulkerrins”) (also known as Christopher Colmen Mulkerrins) failed to ensure that Lion Scaffold Alarms Limited (“LSAL”) used a government-backed Bounce Back Loan (“BBL”) totalling £41,000 in its entirety for the benefit of LSAL. As a result, BBL funds totalling at least £29,264 were paid to Mr Mulkerrins or to his personal benefit and did not provide economic benefit to LSAL, in breach of the BBL terms and conditions. In that: • Under the BBL scheme businesses could borrow up to 25% of their turnover with a maximum loan of £50,000. If the company was established before 01 January 2019, the relevant turnover for determining its eligibility for a BBL was that for the 2019 calendar year, that is its turnover for the period between 01 January and 31 December 2019. The turnover figure was self-certified by the applicant and the BBL scheme terms and conditions stated that BBL funds were to be used to provide economic benefit to the business and not be used for personal benefit. • LSAL was incorporated on 08 September 2013. • On 23 June 2020 LSAL applied for a BBL of £41,000 and on 24 September 2020 LSAL received the BBL funds of £41,000. After receipt of the BBL funds, LSAL’s bank account had a credit balance of £43,260.97. • Between 28 September 2020 and 02 October 2020 receipts totalling £2,540 were received into LSAL’s bank account and payments totalling £4,065 were made from the bank account. • Three payments in the sum of £10,000 each were paid to Mr Mulkerrins on 30 September 2020, 01 October 2020 and 02 October 2020. • At least £29,264.23 of the combined sums of £30,000 paid to Mr Mulkerrins for his personal benefit was derived from the BBL obtained. • Mr Mulkerrins has not provided any evidence to confirm that the funds paid to him were for the economic benefit of LSAL. • Total liabilities at liquidation were £43,900, including £28,345 owed to the bank in respect of the BBL obtained.
