Conduct: Besmir Ahmataj (“Mr Ahmataj”) breached his duties as a director of Frinton HCW Ltd (“Frinton”) by failing to ensure that it complied with legislative requirements in that: • Frinton did not comply with its statutory obligations under The Immigration, Asylum and Nationality Act 2006 ("the 2006 Act") resulting in the employment of 2 people who did not have the right to work in the United Kingdom; • Home Office Immigration Enforcement ("HOIE") after investigating Frinton, issued a Notification of Liability for a Civil Penalty of £30,000 in respect of the employment of these workers, payment of which was due on or before 28 August 2023; • Frinton did not pay the penalty of £30,000 to HOIE, which remained outstanding upon Frinton’s liquidation; • Mr Ahmataj was the sole appointed director of Frinton at the time of the breach of the Immigration, Asylum and Nationality legislation.
