Conduct: Shanawas Babu (‘Mr Babu’) caused Modus Live Business Consulting Limited (‘MLBC’) to breach the terms and conditions of the Bounce Back Loan (‘BBL’) facility by applying for a BBL of £50,000 when he knew or ought to have known that MLBC was not entitled to the loan, having previously applied for and obtained a £50,000 BBL from a different financial institution, contrary to the BBL Scheme terms, in that: • Under the BBL scheme, businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of its turnover for the calendar year 2019. The turnover figure was self-certified by the applicant. The BBL scheme eligibility criteria allowed for businesses to only receive one BBL. • On 23 May 2020 Mr Babu applied to Bank A for a BBL of £50,000, which was received into MLBC’s account held with Bank A on 27 May 2020 • On 6 June 2020 Mr Babu applied to Bank B for a BBL (“BBL2”) of £50,000, which was received on 11 June 2020 into MLBC’s account held with Bank B. • In his application for BBL2, Mr Babu signed to declare that, “I/We confirm that this is my/our only application for a Bounce Back Loan for this business.” • MLBC breached the terms of the BBL scheme by obtaining the second BBL and received £50,000 more than it was entitled to. • MLBC entered Creditors’ Voluntary Liquidation on 19 October 2022 • At liquidation £50,443 remained outstanding in respect of Bank A’s BBL and £51,212 in respect of Bank B’s BBL
