Conduct: Between 6 January 2016 and 10 March 2016 Keith Nicholas Hancock (Mr Hancock) failed to ensure that LAD Media Limited (“Lad”) complied with its statutory obligations under the Privacy and Electronic Communications (EC Directive) Regulations 2003 (“PECR”) in that it instigated the transmission of 393,872 unsolicited communications by means of electronic mail to individual subscribers for the purposes of direct marketing which is contrary to regulation 22 of PECR, as a result of which at least 158 unsolicited direct marketing text messages were made on its behalf to members of the public who had not consented to messages, in that:

  • On 15 February 2016 the Information Commissioner’s Office (“ICO”) informed ‘Lad’ that it had received complaints from individuals in relation to unsolicited texts and asked about their compliance with PECR.
  • The company explained that it purchased the data used to send text messages from a third party data supplier. The text messages had then been sent on its behalf by another third party.
  • The ICO have established that the company used a public telecommunications service for the purposes of instigating the transmission of 393,872 unsolicited communications by means of electronic mail to individual subscribers for the purposes of direct marketing which is contrary to regulation 22 of PECR.
  • On 4 November 2016 ICO issued a Notice of Intent to ‘Lad’ which included a proposed penalty of £50,000.
  • The ICO issued a Monetary Penalty Notice to ‘Lad’ on 18 January 2017 under S55A & 55B of the Data Protection Act 1998. A penalty of £50,000 was issued against ‘Lad’ for sending unsolicited direct marketing texts which was due to be paid to the ICO by 20 February 2017 .
  • ‘Lad’ lodged an appeal against the decision/amount of the fine which was allowed on 9 June 2017 and the penalty reduced from £50,000 to £20,000
  • The penalty was not paid.
  • A Winding up order was made on the petition of ICO on 25 April 2018
