Conduct: Katrina Kathleen Sherwin, (Ms Sherwin) failed to ensure that K & S Transport Limited (“K&S”) complied with its statutory duties under The Goods Vehicles (Licensing of Operators) Act 1995 between 29 November 2016 and 20 December 2017, when the company ceased to trade, in that:

  • K&S was subject to preliminary hearing on 29 November 2016 by The Driver and Vehicle Standards Agency (“DVSA”) whereby in order to keep its operator’s licence, it made a series of undertakings to rectify the breaches that had been identified under the investigation. A public enquiry was not called at this time.
  • Following a roadside inspection of a vehicle on 21 April 2017 which found brake defects considered to be longstanding, a further DVSA inspection commenced on 25 August 2017 which found that the undertakings entered into on 29 November 2016 had only partly been complied with and identified a number of shortcomings in K&S’s maintenance systems, procedures and records which, DVSA concluded, put road safety at risk and gave K&S a competitive advantage over other operators who were complaint with the legislation.
  • This resulted in a public enquiry being called on 09 April 2018.
  • At the public hearing, adverse findings were found under: o Section 26 (1) (c) (iii), that vehicles or drivers have been issued with prohibition notices by DVSA or police in the past five years; o Section 26 (1) (ca), that the company or their drivers have been issued with relevant fixed penalty notices in the past five years; o Section 26 (1) (e), that statements made when applying for the operators licence were not fulfilled, namely that vehicles would be inspected at 4 weekly intervals; o Section 26 (1) (f) of the Act, that the operator has not honoured undertakings they signed up to when applying for the operators licence; o The operator no longer satisfies the requirement to be of good repute in breach of 13A(2) and 27(1)(a) of the Act; o The operator no longer satisfies the requirement to be professionally competent in breach of 13A(2) and 27(1)(a) of the Act;
  • On 17 April 2018, The Traffic Commissioner for Wales decided that the Operators Licence for K&S be revoked immediately and that K&S’s transport manager be disqualified indefinitely from holding or applying for a transport manager job within the EU for an indefinite period.
