Conduct: Vincent Martin O’Donnell (“Mr O’Donnell”) failed to ensure that V&S Euro Logistics Limited (“V&S”) made full, timely payments to HM Revenue & Customs (“HMRC”) and caused V&S to trade to the detriment of HMRC in respect of Value Added Tax (“VAT”) from 7 September 2014 and Corporation Tax (“CT”) from 1 February 2015. In that:-

  • V&S submitted its VAT returns for VAT quarters 07/14 to 10/17 disclosing a total VAT liability of £19,657.18 against which V&S received credits totalling £701.85;
  • HMRC issued default surcharges against V&S in the total sum of £2,605.09;
  • The earliest unpaid VAT liability relates to the return for the quarter ended 31 July 2014, which fell due for payment on 07 September 2014;
  • The last payment by V&S towards its VAT liability was made on 1 May 2014 in the sum of £375, which was allocated against the 01/14 VAT return;
  • V&S submitted claim returns for VAT quarters 07/15, 04/17 and 07/17 that were off-set against the 01/14, 04/14 and 07/14 VAT returns;
  • V&S submitted its CT returns for years ended 30 April 2014, 30 April 2015 and 30 April 2016 disclosing a total CT liability of £12,986;
  • HMRC issued CT penalties against V&S in the total sum of £3,814;
  • Unaudited accounts for the year to 30 April 2016 disclose an overdrawn director’s loan account of £28,731;
  • Analysis of V&S’s bank statements shows that from 7 September 2014 to 11 April 2018, sums of at least £189,505 were received into the Company’s account and payments of £191,241 were made from the account, of which £37,897 was transferred to unknown bank accounts; £21,708 was withdrawn in cash; and £11,740 paid to him while no payments were made to HMRC.
