Conduct: James Christopher Pilkington (“Mr Pilkington”) failed to ensure that The New Inn Fremington Limited (“TNIF”) complied with its statutory obligations to submit returns and make payments to HMRC in respect of VAT and PAYE and caused TNIF to trade to the detriment of HMRC from 7 September 2014 at the latest. In that: VAT & PAYE/NIC

  • VAT returns for all periods from the quarter ended 31 July 2014 to the quarter ended. 30 June 2016, showing total tax due of £47,960, were submitted on 08 March 2017. £1,300 was paid in respect of this liability leaving £46,660 outstanding at liquidation;
  • VAT returns for the quarters ended 30 September 2016 and 31 December 2016, showing total tax due of £9,836, were submitted on 26 May 2017. No payments were made in respect of this liability;
  • No VAT returns were submitted for the periods ended 31 March 2017, 30 June 2017 and 30 September 2017 and HMRC therefore estimated that there was total tax due of £15,606;
  • PAYE/NIC of £5,670 was due for all tax years from 2014/15 to 2017/18, against which payments of £2,121 were made.
  • At liquidation, total VAT of £72,102 and PAYE/NIC of £3,549 remains unpaid. DETRIMENTAL TREATMENT
  • Accounts covering the period from when trading began on 28 April 2014 to 31 March 2016 show total turnover of £415,501. In the whole period of trading just £3,421 was paid to HMRC.
  • Accounts to 31 March 2015 show liabilities to HMRC of £23,590 and other creditors of £21,952. By liquidation HMRC claimed £75,651 while other creditors totalled £32,879.
