Conduct: Mr Robert Thomas Ryan (“Mr Ryan”) caused Fortuna Joinery Limited (“the company”) to trade to the detriment of HM Revenue and Customs (HMRC) in breach of its statutory obligations by failing to ensure that all VAT returns were submitted and all payments made in respect of VAT from 7 November 2013. In that:

  • VAT returns were made for the quarters 09/13 (due for payment on or before 7 November 2013) to 06/14 totalling £64,161 against which £1,356 was paid.
  • Although no further returns were made to HMRC, accounting records show that for the quarters 09/14 to 03/15 VAT of £22,204 was due. HMRC raised assessments for the quarters 06/15 to 03/16 totalling £2,812 (excluding Surcharges of £486).
  • At liquidation, HMRC claim is for £77,892.30 comprising VAT £70,815.48, PAYE £1,612.27, CIS £1,435.54 and surcharges, interest and costs £4,029.01.
  • During the period from 8 November 2013 to 1 July 2016 (the date of the last commercial receipt) bank payments totalled £583,251.64 of which only £8,313.50 was paid to HMRC and the net benefit to him was £60,348.00.
