Conduct: Mr Elias Miah (“Mr Miah”) caused Bengal Palace Restaurant Limited (“BPR”) to breach the terms and conditions of the Bounce Back Loan ("BBL") scheme by applying for a BBL of £50,000 to which he knew or ought to have known BPR was not entitled. Consequently, BPR received monies that it was not entitled to from the BBL scheme, in that: • The Bounce Back Loan (“BBL”) criteria allowed a company to borrow between £2,000 and a maximum of £50,000 based on 25% of the company’s turnover for the 2019 calendar year. • The eligibility criteria was that a business was carrying on its business on 01 March 2020 and that it was engaged in trading or commercial activity as at the date of the BBL application and that the business has been adversely impacted by COVID-19. • BPRs was incorporated on 05 March 2013 and commenced trading since 05 March 2013. BPR ceased trading on 22 February 2020. • In the BBL application form completed by Mr Miah on 22 June 2020 the turnover for the 2019 calendar year was stated to be £224,000. • The BBL of £50,000 was paid into the company bank account on 24 June 2020. • The Company’s financial statements for year ended 30 April 2019, approved by Mr Miah on 07 January 2020, state that the Company’s turnover was £78,904. The Company’s financial statements for year ended 30 April 2020, approved by Mr Miah on 20 January 2021, state that the Company ceased trading on 22 February 2020. • On the basis of the above information BPR was not eligible for a BBL. As such BPR obtained a £50,000 BBL that it was not entitled to. • On 24 June 2020 £47,000 was paid out the Company’s bank account to a third party. The payments were funded by the BBL. There is no evidence these payments were for the benefit of the business.
