Conduct: Mr Mohammed Altafur Rahman ('Mr Rahman') failed to register Red Fort Tandoori Restaurant Kent Ltd ('RFT') for VAT when it had reached the threshold for registration in May 2013. He also caused RFT to submit inaccurate VAT returns from its first return in November 2013 to at least November 2016 and failed to record all sales made by RFT in this period. In addition he caused RFT to file inaccurate accounts and submit inaccurate Corporation Tax returns. HMRC have claimed 418,834 in the liquidation. In that:

  • RFT registered for VAT on 01 November 2013, however its turnover exceeded the VAT threshold in May 2013;
  • RFT did not file accurate VAT returns up to at least November 2016;
  • In addition, not all sales were entered into RFT's records and an estimated 430 per week was not recorded;
  • As a consequence HMRC raised an Officer's Assessment for 100,982 of additional VAT due for the quarters November 2013 to November 2016;
  • Penalties of 43,933 were issued to RFT for understating its takings and failure to register for VAT on time;
  • Accounts filed at Companies House do not accurately show RFT's turnover for the years ended 31 January 2014 to 2016 and those for the year to 31 January 2017 are identical to the previous year;
  • Corporation Tax returns for 2014 to 2016 were submitted to HMRC based on the filed accounts and showed nil due for each year;
  • Following the VAT enquiry HMRC assessed that a further 138,039 was due for Corporation Tax on under-declared sales;
  • It also raised additional penalties of 62,807.
