Conduct: Coolertech Limited 1) Mr Paul John Burridge (“Mr Burridge”) failed to ensure that Coolertech Limited (“Coolertech”) paid over employees’ pension deductions and employer pension contributions totalling £11,222 to the company’s pension scheme provider from April 2019 to March 2020, resulting in a loss to the employees’ pension funds. 2) Mr Paul John Burridge (“Mr Burridge”) failed to ensure that Coolertech Limited (“Coolertech”) complied with its statutory obligations to HM Revenue & Customs (“HMRC”) to file returns and make payments when due and caused Coolertech to trade to the detriment of HMRC from at least 22 December 2019 to 23 August 2023, the date of liquidation, resulting in a liability to HMRC of at least £440,728 in that: • The PAYE/NIC account had a credit balance on file of £2,048 as of 16 December 2019. • Coolertech subsequently submitted the PAYE/NIC returns for the months ending 5 December 2019 to 5 July 2021 without payment, resulting in a liability of £76,308. • HMRC also issued a late filing penalty in respect of the PAYE/NIC return for the month ending 5 July 2020 for £200. • This resulted in a total PAYE/NIC liability owing to HMRC of £74,460. • Coolertech submitted the VAT return for the quarter ending 31 December 2019 without payment, resulting in a liability of £39,941. • Coolertech then failed to submit any further VAT returns, which led to HMRC issuing assessments for the quarters ending 31 March 2020 to 30 September 2021, resulting in a liability of £302,632. • HMRC also issued VAT surcharges for the quarters ending 30 September 2020 to 30 September 2021, resulting in a liability of £22,694. • This resulted in a total VAT liability of £365,267. • HMRC issued a penalty for £1,000 in respect of the Corporation Tax for the year ending 30 March 2020. • Analysis of the bank statements for the period 22 December 2019 to 14 August 2023 shows Coolertech received £991,175. A total of £475,402 was paid to trade creditors, £351,087 was paid to employees, £35,046 was paid to or for the benefit of Mr Burridge and £160,082 was paid to associated parties whilst no payments were made to HMRC. • At the date of liquidation, at least £440,727 was owed to HMRC in respect of VAT, PAYE/NIC and Corporation Tax. 3) Mr Paul John Burridge (“Mr Burridge”) caused Coolertech Limited (“Coolertech”) to misuse funds claimed via HMRC’s Job Retention Scheme in that: • Coolertech’s claim for August 2020 included a claim for an employee who had left in July 2020, hence CL received £1,504 more than it was entitled to. • Coolertech’s claim made for January 2021 was in respect of seven employees and totalled £8,418. The funds were used to pay two of the employees, a total of £3,339. Five employees did not receive the funds to which they were entitled and Coolertech benefitted from the remaining £5,079. • Coolertech’s claim made for February 2021 was in respect of seven employees and totalled £10,824. The funds were used to pay one of these employees, a total of £1,437. Six employees did not receive the funds to which they were entitled and Coolertech benefitted from the remaining £9,387. • Coolertech’s claim made for June 2021 was in respect of eight employees and totalled £9,276. The funds were used to pay five of these employees, a total of £7,448. Three employees did not receive the funds to which they were entitled and Coolertech benefitted from the remaining £1,828. • Coolertech therefore received the benefit of Job Retention Scheme funds totalling £17,798 whilst furloughed employees did not receive the financial assistance they were entitled to. Boxed Freeze Limited Mr Paul John Burridge failed to ensure that Boxed Freeze Limited paid over employees’ pension deductions and employer pension contributions totalling £7,440 to the company’s pension scheme provider from April 2019 to February 2020, resulting in a loss to the employees’ pension funds. Lined Out Limited Mr Paul John Burridge failed to ensure that Lined Out Limited paid over employees’ pension deductions and employer pension contributions totalling £11,257 to the company’s pension scheme provider from April 2019 to February 2020, resulting in a loss to the employees’ pension funds. Pressed Supplied Limited Mr Paul John Burridge failed to ensure that Pressed Supplied Limited paid over employees’ pension deductions and employee pension contributions totalling £4,085 to the company’s pension scheme provider from June 2019 to February 2020, resulting in a loss to the employees’ pension funds.
