Conduct: Mr Martin failed to ensure that Meadway, which carried on business as a letting agent, complied with its obligations to (1) pay tenant deposits into a government-backed tenancy deposit protection (TDP) scheme and/or (2) account to landlords and/or tenants for all deposits and/or rents collected. In particular:

  • Meadway carried on business as a letting agent and collected deposits and rents from tenants on behalf of its landlord clients.
  • Meadway failed to pay deposits collected in relation to assured shorthold tenancies totalling at least 19,904 into a government-backed TDP scheme and failed to account to landlords (and/or tenants) in relation to such deposits.
  • In some cases Meadway provided statements of account to landlords which referred to deposits being paid into a TDP scheme when, in fact, no such payments had been made.
  • In addition, known claims by Landlords in respect of rents collected by Meadway but not paid by to the Landlords total 68,271.20.
  • In the absence of adequate accounting records being maintained, preserved and/or delivered up to the liquidator of Meadway, it has not been possible to establish all of the deposits and rents collected by Meadway and what happened to them.
