Conduct: Jacqueline Helen Farbrace (“Mrs Farbrace”) failed to ensure Howfield Response Limited (“Howfield”) complied with its statutory obligations to make all returns and payment in full as and when due to HM Revenue & Customs (“HMRC”). As a consequence from no later than 22 April 2015 Howfield traded whilst to the detriment of HMRC who have claimed £114,060 in the liquidation, in that: PAYE/NIC

  • Howfield incurred PAYE/NIC liabilities for the tax year 2014/2015 of £35,741. HMRC have claimed £9,244 (including interest of £914) in the liquidation for the tax year 2014/2015, which was due to be settled in full by 22 April 2015.
  • Returns submitted to HMRC record PAYE/NIC liabilities of £37,280 for the tax year 2015/2016, of £33,695 for the tax year 2016/2017 and of £8,247 for the tax year 2017/2018. Payments made on account of these liabilities of £79,222 totalled £22,476.
  • HMRC have claimed for PAYE/NIC liabilities of £60,457 in the liquidation comprising; £62 interest for tax year 2013/2014, £9,244 for the tax year 2014/2015, £20,433 (including interest of £17) for the tax year 2015/2016, £25,083 for the tax year 2016/2017 and £5,635 for the tax year 2017/2018. VAT Howfield failed to settle liabilities arising for VAT return periods 09/14 (September 2014) to 08/15 (August 2015). On 4 November 2015 £25,000 on account of these liabilities was paid to HMRC to settle return periods 09/14 to 07/15 and £168.70 of the liability of £2,964.68 for 08/15, leaving £2,795.98 still outstanding for that period.
  • VAT returns were filed with HMRC for return periods 09/15 to 04/17 declaring a total VAT liability of £52,994.59. In the absence of VAT returns being filed for the 4 monthly periods 05/17 to 08/17 HMRC raised assessments totalling £12,761.00.
  • Howfield’s failure to comply with its statutory obligations caused HMRC to raise surcharges of £9,179.03 for all VAT periods 10/15 to 07/17.
  • Payments of £24,296.37 were made on account of the VAT and surcharge liabilities of £77,899.30 for return periods 08/15 to 08/17 leaving £53,602.93 outstanding at the liquidation. Payment of other parties in priority to HMRC
  • Howfield’s records indicate Howfield’s trading income for the period from 1 April 2015 to the liquidation on 8 August 2017 to be in the order of £813,000. In addition a loan of £27,500 was obtained. Of the funds available during the period from 1 April 2015 to the liquidation £121,754 was paid to HMRC on account of VAT (£70,465) and PAYE/NIC (£51,289).
  • The accounts to 30 November 2015 record HMRC due £77,594 and trade and other creditors were owed £66,432.
  • The accounts to 30 November 2016 show HMRC debt increasing to £81,497 and trade and other creditors reducing to £58,033.
  • At the liquidation HMRC have claimed £114,060 whilst trade creditors were due £13,667. Employees, who continued to be paid to at least June 2017, were owed £21,060.
