Conduct: On 27 October 2020 Asoka Bandara Ekanayake (“Mr Ekanayake”) breached the terms of the Government backed Bounce Back Loan (“BBL”) Scheme by causing Sun Global (UK) Ltd (“SGU”) to overstate its turnover on its application for a BBL, resulting in the company receiving a BBL of £50,000 when he knew, or ought to have known, that SGU was not eligible for a loan of that value, in that: • The BBL scheme terms allowed businesses to receive a loan of up to 25% of their annual turnover for the 2019 calendar year, which the applicant would self-certify when completing the BBL application. Businesses could receive a BBL of between £2,000 and £50,000. • If a company was established after 01 January 2019, they were allowed to estimate the company turnover from the date the company started. The terms of the BBL scheme stated that the BBL was to be used only for the economic benefit of the business it was being claimed for, used wholly for business purposes and not personal purposes. • SGU was incorporated on 22 October 2012, so was required to use actual turnover for the 2019 calendar year on the BBL application. • On 27 October 2020 Mr Ekanayake declared on SGU’s BBL application form an annual turnover of £224,620, and consequently on 06 November 2020 SGU received a BBL of £50,000. • SGU’s bank statements for 2019 show income of £452.52. • SGU’s accountants state that SGU’s turnover for 2019 was £20,407. • Based on the accountant’s turnover for SGU for 2019, SGU would have been eligible to apply for a BBL of £5,102 and received £44,898 more than it was entitled to from the BBL scheme. • SGU entered a Creditors Voluntary Liquidation on 21 May 2025. • At Liquidation, SGU had liabilities totalling £60,418.51 of which £49,934.47 was owed to the Bank in respect of the BBL.
