Conduct: Patricia Elizabeth Renwick (“Mrs Renwick”) failed to ensure Tim Renwick Limited (“TRL”) complied with its statutory duty to file returns and make payments when due to HM Revenue & Customs (“HMRC”) and in addition, she allowed TRL to trade to the detriment of HMRC from at least 01 October 2014 in respect of Corporation Tax and from at least 07 May 2015 with regard to Value Added Tax (“VAT”). In that: Corporation Tax

  • According to a return submitted for the year ended 30 December 2013, which should have been paid by 01 October 2014 at the latest, £19,180 was due for payment. TRL made a payment of £6,500 leaving an outstanding liability of £12,680. According to HMRC, TRL had a combined liability for the Years Ended 30 December 2014 and 2015 of £97,000. TRL failed to make any payments towards this liability.
  • The total outstanding sum owed with regard to Corporation Tax stands at a minimum of £129,480 including penalties of £19,800. VAT
  • TRL failed to submit a return for the period 03-15. The outstanding liability for this period should have been paid by 07 May 2015 at the latest. In the absence of a filed return HMRC raised an assessment in the sum of £1,926. TRL failed to make any payments towards this liability and the sum remained outstanding as at the date of the liquidation.
  • In the absence of filed returns, HMRC raised assessments for the periods 06-15 to 09-17 with £36,169 due for payment. TRL failed to make any payments and these liabilities remained outstanding as at the date TRL entered in compulsory liquidation.
  • From 07 May 2015 TRL made payments totalling £4,109. These payments were offset against assessments raised for the periods 09-14 and 12-14.
  • The outstanding liability owed to HMRC in relation to VAT stands at £43,022, including surcharges of £4,927. Detrimental Treatment of HMRC
  • Despite making a profit after tax of £93,222 for the Year Ended 30 December 2015, payments received by HMRC only amounted to £14,651 during that period.
  • Between 31 December 2015 and 04 September 2017, payments from clients into TRL’s bank account amounted to £280,344. However, TRL only made a payment of £100 to HMRC.
  • As at the date of liquidation TRL’s overall liabilities to unsecured creditors amounted to £177,643 with £172,502 due to HMRC.
