Conduct: Mihaita Cojocaru (“Mr Cojocaru”) caused Lushtrans Ltd (“LT”) to apply for a second and third Bounce Back Loan (BBL) of £32,000 and £30,000 respectively. LT was not entitled to apply for more than one BBL under the eligibility requirements for the BBL scheme and, as a result, LT received £62,000 more than it was entitled to. In that A Company was entitled to apply for one BBL of up to 25% of its 2019 turnover up to a maximum of £50,000 under the BBL scheme. In the BBL application form, the applicant had to declare that the company was not in the process of applying for or had already received a Bounce Back Loan. LT was incorporated on 24 September 2012 and commenced trading on the same date. On 23 May 2020 Mr Cojocaru applied for a BBL of £10,000 with Bank A (“BBL1”). BBL1 was paid into the company’s account on 26 May 2020. On or around 2 June 2020 Mr Cojocaru applied for a second BBL of £20,000 with Bank B (“BBL2”). This was paid into the company’s account on 3 June 2020. A BBL Top-Up of £12,000 was applied for with Bank B and received on 17 November 2020. On 10 August 2020 Mr Cojocaru applied for a third BBL of £30,000 with Bank C (“BBL3”). This was paid into the company’s account on 12 August 2020. As a result of the multiple applications LT received £62,000 more than that to which it was entitled given only 1 BBL was permissible. At liquidation £68,440 remained outstanding in respect of the BBLs obtained.
