Conduct: Mr Davinder Gurche ("Mr Gurche") caused Home James & Central Private Hire Ltd ("Home James") to fail to register for Value Added Tax ("VAT") between 30 September 2013 (when its Corporation Tax returns showed that its turnover had exceeded the threshold to register for VAT) and 01 August 2015, resulting in lost revenue to HMRC which it estimated at 57,552 and the imposition of a VAT Penalty of 40,286 which remained unpaid at the date of liquidation. Home James failed to respond to HMRC's requests for information which were necessary in order to accurately calculate Home James' VAT liability for this period. In particular:

  • Home James' Corporation Tax Returns for the periods 01 October 2012 to 30 September 2013 and 01 October 2013 to 30 September 2014 declared a turnover which exceeded the VAT threshold.
  • Mr Gurche was familiar with the requirements to register for VAT having failed to register another company for VAT in 2003.
  • On 24 August 2015, HMRC wrote to Home James and stated it had been unable to trace a VAT number for the company. HMRC requested details of Home James' monthly turnover. Home James failed to respond to this request for information.
  • Home James submitted a VAT 1 Application for Registration for VAT on 09 September 2015, which was back dated to 01 August 2015 and which stated it was required to register for VAT (compulsory registration) as its taxable turnover had exceeded the threshold in the previous 12 months.
  • Home James failed to respond and/or provide the information requested in HMRC's Notice to Provide Information dated 09 October 2015 and therefore incurred a penalty of 300 dated 20 November 2015.
  • Before the date of Mr Gurche's resignation as a director of Home James on 05 April 2016, Home James failed to respond to and/or provide the information requested in HMRC's letters dated 20 November 2015; 26 November 2015 and 03 February 2016.
  • HMRC issued Home James with a VAT Penalty for deliberately failing to notify/register for VAT at the correct time in the sum of 40,286 on 19 May 2016 and which remained unpaid as at the date of Home James' liquidation.
