Conduct: Richard Deevey (“Mr Deevey”) caused or allowed Red Rum Plumbing & Heating Limited (“Red Rum”) to trade to the detriment of Her Majesty Revenue and Customs (HMRC) from 07 May 2014 in that: VAT Value Added Tax (VAT) returns were submitted for the periods from 03/14 to 09/15 declaring a total liability of £30,973.33. In the period 12/15 to 06/16 (at which point the company ceased trading) no returns were submitted and assessments were raised totalling £1,034.00. In the period 03/14 to 06/16, payments of £13,819.58 were made leaving a balance of £18,187.75 Following the liquidation of the Company HMRC carried out a review of the returns that were submitted and raised additional assessments for the periods 12/13, 06/14, 03/15 and 06/15 resulting in an additional liability of £11,407. Additional assessments were also raised for the periods 12/15 to 6/16 resulting in an additional liability of £21,922. The overall liability to HMRC in respect of VAT as a result is £51,516.75 PAYE / NIC For the Pay As You Earn/ National Insurance Contributions (PAYE/NIC) year 2014/2015, returns were submitted declaring a total liability of £5,157.39. £1,943.95 remains outstanding, representing the period January to April 2015. For the PAYE/NIC year 2015/2016, 2 returns were submitted declaring a liability of £56,106.32. In the absence of returns, HMRC estimated the liabilities for the remaining 10 month period to be £1,178.86. No payments have been made against this total liability of £57,285.18. For the PAYE/NIC year 2016/2017, 2 returns were submitted declaring a liability of £7,630.76. In the absence of returns HMRC estimated the liability for the remaining period as £20,223.34. No payments were made in respect of this liability leaving £27,854.10 outstanding. The overall liability to HMRC in respect of PAYE/NIC including penalties and interest charges is £91,609.81. CORPORATION TAX Red Rum submitted a corporation tax return for the period to 30 September 2014 declaring a corporation tax liability of £12,643.40 that was payable in full by 1 July 2015. HMRC record payment of £7.99 against this liability and have claimed £12,635.41 in the liquidation together with a penalty of £100. COMPARATATIVE TREATMENT OF HMRC In the period from 14 July 2014 to liquidation on 7 October 2016, Red Rum expended £635,322 from its bank account of which HMRC received £9,152. Over the same period a net amount of at least £94,612 was paid to Mr Deevey and a net amount of at least £96,210 to his fellow director, Mr Molloy. Other non HMRC payments totalled £448,603. The accounts to 30 September 2014 record HMRC were due £16,643 and other creditors £11,987. HMRC have claimed £168,287 in the liquidation whilst Mr Deevey has claimed £11,550 and Mr Molloy £12,653. The Bank was included in the Statement of Affairs as due £10,652 and trade creditors £70,274. Period
