Conduct: Ms Carly Jayne Toms, also known as Carly Jayne Donnely, (“Ms Toms”) caused Saving Grace Aesthetics Ltd (Saving Grace) to obtain a government-backed Bounce Back Loan (BBL) of £50,000 by overstating its annual turnover which she knew or ought to have known the figure provided was false. Saving Grace therefore obtained £17,379 of BBL funding to which it was not entitled, in that: • Saving Grace was incorporated on 31 July 2012. • The BBL scheme permitted a loan of up to 25% of a business’ turnover in the 2019 calendar year or estimated turnover if it had been established after 01 January 2019. • Saving Grace was established before 01 January 2019 and so it was required to use its actual 2019 turnover figure in the BBL application. • The BBL application was completed by Ms Toms on 21 May 2020. Ms Toms self-declared the annual turnover for Saving Grace as £200,000. • The company accounts for the year ended 31 July 2019 confirm that Saving Grace had a turnover of £135,392. • The company bank account statements confirms that the total credits into the company account in the calendar year 2019 was £130,482. • The BBL of £50,000 was credited into the bank account of Saving Grace on 02 June 2020. • Based on the bank account analysis and under the terms of the BBL scheme, Saving Grace was entitled to apply for BBL funding to a maximum of £32,621. Therefore, it received £17,379 which it was not entitled too. • The BBL remained outstanding at liquidation.
