Conduct: Mr Alistair Green (also known as Shaya Green) (“Mr Green”) caused Exquisite Trimmings Ltd (“ETL”) to act in breach of the rules of the Government-backed bounce back loan (‘BBL’) scheme by obtaining a BBL of £50,000, a sum at least £30,797 in excess of the BBL to which ETL was reasonably entitled, when he knew or ought to have known that ETL was not entitled to a loan of £50,000, by making a wrongful declaration on the BBL application form that in respect of ETL’s turnover in the 2019 calendar year, in that: • The rules of the BBL Scheme were such that a business could apply for a loan of up to 25% of annual turnover, from a minimum of £2,000 up to a maximum of £50,000. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019 if the applicant was established on or before 01 January or, if established after 01 January 2019, an estimate of annual turnover. • On 10 May 2020 ETL applied to its bank, Bank A, for a BBL of £50,000. • As ETL had been trading from 2012, its 2019 calendar year turnover was required on the BBL application form. • According to its accounts for the year to 30 June 2019, the Company had turnover of £57,705. • According to its accounts for the year to 30 June 2020, the Company had turnover of £86,295. • According to bank statements on its current account with Bank A, ETL received trade credits in the 2019 calendar year of a total of £76,812. Turnover of such a figure meant that ETL was entitled to apply for a BBL of up to £19,203. • Mr Green told Bank A that ETL’s turnover for the 2019 calendar year was £200,000 and requested a BBL of £50,000. • Bank A approved the application and released the loan monies to ETL on 18 May 2020. • The Company was placed into creditors’ voluntary liquidation on 17 January 2024. • No repayments were made towards the BBL and Bank A provided the Liquidator with a proof of debt for the BBL in the sum of £50,694.
