Conduct: Coastan Ahumuza (“Mr Ahumuza”) caused RCT Accountants Ltd (“RCT”) to provide inaccurate information when applying for a Bounce Back Loan (“BBL”) of £50,000 on 8 July 2020 and did not use the funds obtained for the economic benefit of RCT. In that: The Government’s BBL rules allowed small and medium sized businesses adversely affected by Coronavirus to borrow between £2,000 and £50,000 up to a maximum of 25% of their turnover. RCT’s accounts for year ended 31 January 2020 show annual turnover for the year of £3,011. Therefore, RCT was not entitled to receive any BBL funds. Mr Ahumuza inaccurately declared turnover of £425,000 on the application form and a BBL of £50,000 was paid into the company bank account on 9 July 2020. Mr Ahumuza has stated to the Insolvency Service that he combined the turnover of his three other companies to arrive at this figure. By 20 July 2020 £50,000 of the BBL funds had been paid to a company of which Mr Ahumuza was a director. He has failed to satisfactorily explain the transfer of the BBL funds. At the date of liquidation, £50,000 of BBL funds remain outstanding.
