Conduct: Mr Yeabor Ullah, (“Mr Ullah”), caused Bengal Spice Hemel Limited, (“BSH”), to transfer at least £48,326 of a Government-backed Bounce Back Loan (“BBL”) to himself which was not to the economic benefit of BSH and therefore was contrary to the terms and conditions of the scheme. In that: • BSH received the BBL totalling £50,000 into its bank account on 07 July 2020. • Prior to receipt of the BBL, BSH’s bank account was in credit by £1,674.12. • On 07 July 2020, Mr Ullah transferred £50,000 to his personal account. £48,326 of which had to have been funded by the BBL proceeds. • Mr Ullah states that this payment was to reimburse him for money he had given to BSH for wages and rent but no evidence has been provided to verify this. • The bank is a creditor in BSH’s liquidation and has claimed £48,000 for the outstanding BBL.
