Conduct: On 19 June 2020 Gregory Christopher Adams (“Mr Adams” caused AGCJ Limited (“AGCJ”) to apply for a Government backed Bounce Back Loan (“BBL”) of £50,000 when he knew, or ought to have known that AGCJ was not eligible for that amount, In that: • Under the BBL scheme a business that was established before 01 January 2019 could apply for a loan of 25% of its turnover in the calendar year 2019, from a minimum of £2,000 up to a maximum of £50,000. Where a business was established after 1 January 2019, a company was entitled to base the 25% limit on its estimated annual turnover from the date it started its business. • AGCJ was incorporated on 10 April 2012, therefore in applying for a BBL must use calendar year 2019 turnover as opposed to an estimated turnover; • On 19 June 2020, Mr Adams applied for a BBL of £50,000 on behalf of AGCJ and declared a turnover of £230,000; • On 23 July 2020, £50,000 BBL was paid into AGCJ’s bank account; • AGCJ’s bank statements for the calendar year of 2019 show a turnover of £14,720 and it’s BBL eligibility cannot have exceeded £3,680; • At the date of liquidation, 15 September 2022, £48,447 remained outstanding on the BBL account.
