Conduct: Mr Nikky Caulfield (“Mr Caulfield”) caused NSC Installations Limited (“NSC”) to breach the terms and conditions of the Bounce Back Loan (“BBL”) scheme by overstating its turnover in an application to obtain a BBL of £50,000. This resulted in the Company receiving a £50,000 BBL that it was not entitled to. In that: • Under the BBL scheme rules, a company that was engaged in trading or commercial activity at the date of the application, was carrying on business on 01 March 2020 had been adversely affected by coronavirus (COVID-19) was eligible for one BBL of 25% of its 2019 calendar year turnover, up to a maximum of £50,000. • NSC was incorporated on 29 March 2012. Mr Caulfield was appointed director on 29 March 2012 and remained as such until NSC liquidation on 16 May 2024. • On 16 May 2020 Mr Caulfield applied for a BBL of £50,000 from the Lender. The company received a BBL of £50,000. • NSC’s accounts filed for the year ended 31 March 2019 and 2020 shows turnover of £23,633 and £32,610. Analysis of NSC’s bank account shows that NSC had credits of £23,527.48 for the calendar year 2019. • Based upon the credits paid in NSC’s bank account in the calendar year 2019 (£23,527.48), NSC would have been eligible for one BBL of £5,881.87, NSC therefore received £44,118.13 in BBL funds than it should have. • The BBL outstanding totals £46,469.25 and the bank is a creditor in the Liquidation.
