Conduct: On 11 June 2020 Mr Mohammed Moshiur Rahman Dulal (‘Mr Dulal’) caused Metro Travels Plus Company Limited (‘Metro’) to apply for a Government-backed Bounce Back Loan (‘BBL’) of £50,000 to which it was not entitled, by providing false and/or inaccurate information regarding Metro’s turnover in 2019. Furthermore, there is no evidence that the proceeds of the BBL were used in their entirety for the economic benefit of the business, as required under the terms of the BBL scheme. In that: Obtaining a BBL • The BBL scheme permitted a loan of up to 25% of a business’ turnover in the calendar year 2019, or estimated turnover if it had been established after 01 January 2019. • Metro was incorporated on 23 March 2012. • Metro held a business bank account with Bank A. The bank account was opened on 22 October 2019. Prior to that, Metro held a bank account with Bank B. • On 11 June 2020 Mr Dulal applied for a BBL of £50,000 with Bank A, stating that Metro’s turnover in 2019 was £222,500. • Metro’s bank statements for Bank A show income into the account from the date of opening (22 October 2019) until 15 June 2020 when the BBL funds of £50,000 were credited to the account of £6,484.63. • The accounts made up to 31 March 2020, authorised by you, state a turnover of £21,240 for 2019 and £27,350 for 2020. • Metro was not eligible for the maximum BBL of £50,000. It was eligible for £6,750. Disbursal of BBL • On 15 June 2020, the day before the BBL was credited to Metro’s account, the balance on the account was £66.30 • During the 6 months following receipt of the BBL, you state you paid £20,000 in cash and a sum of £6,000 by direct transfer (on 23 December 2020) to a third party by way of a loan. • During this period, the only credits into the account were £4,100.24 of JRS Grants, £400 from a third party and a refund of £395.32 from LCC (total of £4,895.56). As such at least £21,000 of any funds paid to the third party would have related to the BBL. • These payments did not provide any the economic benefit of Metro. At the liquidation date £37,095.53 of the BBL remains outstanding.
