Conduct: Ahsan Kabir (“Mr Kabir”) caused Cinnamon Littlehampton Limited (“Cinnamon”) to deliberately submit inaccurate information to HM Revenue & Customs (“HMRC”) for the periods between 21 March 2012 and 31 October 2016, resulting in an outstanding liability to HMRC of £520,758.54 when Cinnamon entered liquidation on 14 February 2018. In that:

  • Cinnamon operated a restaurant and takeaway business from April 2012 to October 2016.
  • Between 28 July 2016 and 6 October 2016, HMRC conducted a test purchase exercise and two unannounced inspections of Cinnamon’s trading premises.
  • HMRC’s investigation concluded that Cinnamon had deliberately concealed cash sales and other income, and submitted inaccurate Corporation Tax and Value Added Tax (“VAT”) returns, under-declaring its net turnover by £621,513.68, its Corporation Tax liability by £110,877 and its VAT liability by £60,416.92.
  • As a result of HMRC’s finding that Cinnamon’s actions were deliberate and concealed, Cinnamon was subject to penalties of 70% of its assessed undisclosed Corporation Tax and VAT liabilities.
  • When Cinnamon entered liquidation on 14 February 2018, it had total liabilities of £536,245.17, of which £520,758.54 was claimed by HMRC.
