Conduct: Pieter Richard Van Ommen (Mr Van Ommen) caused Casmar Limited (“Casmar”) to trade to the detriment of HM Revenue and Customs (“HMRC”) and to his own benefit from at least 10 November 2013 resulting in liabilities of at least £37,643, including surcharges, interest and penalties of £1,870 in respect of Corporation Tax, VAT and PAYE/NIC at liquidation:

  • A Corporation Tax liability of £7,415 for the year ended 09/02/13 was due to be paid by 10/11/13. No payment was made and the full amount remained outstanding at liquidation
  • A Corporation Tax liability of £506 for the period ended 28/02/13 was due to be paid by 29/11/13. No payment was made and the full amount remained outstanding at liquidation
  • A Corporation Tax liability of £10,929 for the year ended 28/02/14 was due to be paid by 29/11/14. No payment was made and the full amount remained outstanding at liquidation
  • A penalty of £200 was charged for the non-submission of the Corporation Tax return for the year ended 28/02/15 which remained outstanding at liquidation. Interest of £1,451 also remained outstanding at liquidation.
  • Between March 2014 and September 2015, Casmar was liable to pay VAT totalling £19,274 to HMRC. Payments totalling £6,414 were made between July 2014 and April 2015 leaving a balance of £12,860 plus surcharges of £219 outstanding at liquidation
  • Casmar was liable to pay £5,268 to HMRC in respect of PAYE and NIC deductions for the tax years 2013/14 to 2015/16. Payments totalling £813 were made between May 2013 and January 2014. After Employment Allowance of £392, a balance of £4,063 remained outstanding at liquidation
  • Between March 2014 and liquidation he drew £86,360 in excess of his and connected party’s salary entitlements from Casmar. In the same period HMRC were paid £6,414.
  • HMRC have submitted a claim in the liquidation for £45,417. There are no other creditors.
