Conduct: Kulbir Pannu (‘Mr Pannu’) breached his duties as a director of Kensington Food & Wine Ltd (‘Kensington’) by failing to ensure that it complied with its legislative duties, in that: • Kensington did not comply with its statutory obligations under The Immigration, Asylum and Nationality Act 2006 (‘the Act’) resulting in the employment of two individuals who did not have the right to work in the UK. • Home Office Immigration Enforcement (“HOIE”) carried out a visit to Kensington’s trading premises on 14 May 2024 and identified two workers who did not have the right to work. • HOIE issued a Notice of Liability for Civil Penalty on 05 June 2024, amounting to £80,000 in respect of the employment of two workers. • Although Mr Pannu submitted an Objection Notice, the penalty was upheld and the Objection Outcome Notice stated that payment was due on or before 16 August 2024; • Kensington has not paid the penalty due to HOIE and has therefore not complied with its requirements under the Act. • Mr Pannu was the sole director of Kensington at the time of the breach of the Act. • At Liquidation on 12 September 2024, Kensington had liabilities of £105,870 of which £80,000 related to the HOIE penalty
