Conduct: Julius Dammy Ogunkola (“Mr Ogunkola”) breached the terms of the Bounce Back Loan (“BBL”) scheme by causing Julic Services Limited (“JSL”) to apply for a BBL when he knew or ought to have known it was not eligible to do so, in that: • The BBL scheme terms allowed businesses to receive a loan of up to 25% of their annual turnover for the 2019 calendar year, which the applicant would self-certify when completing the BBL application.    Businesses could receive a BBL of between £2,000 and £50,000. • When applying for a BBL companies had to sign a declaration confirming that the Company was carrying on its business on 01 March 2020 and was trading or engaged in commercial activity on the date of the BBL application. • JSL was incorporated at Companies House on 03 January 2012 but filed dormant annual accounts for years ending 31 January 2020. • JSL opened a bank account in June 2020, and the first potential business income was deposited into that account on 03 July 2020. • The BBL scheme application form summary shows Mr Ogunkola declared a turnover figure of £200,000 for the year 2019. • On 31 July 2020 JSL received a £50,000 BBL into its bank account (the maximum amount available), which it was not eligible for given it was not carrying on business on 01 March 2020 or engaged in in trading or commercial activity at the time of the BBL application. Furthermore, Mr Ogunkola failed to use the entirety of the BBL obtained by JSL for the economic benefit of the company, in that: • The terms of the BBL scheme stated that the BBL was to be used only for the economic benefit of the business, used wholly for business purposes and not personal purposes. • The bank balance prior to receipt of the BBL was £4,485.76. • After receipt of the £50,000 BBL on 31 July 2020, payments totalling £50,610 were made to Mr Ogunkola between 03 August 2020 and 10 March 2021. • A further £1,490 has been withdrawn in cash between 07 August 2020 and 19 November 2020. • Of the £50,610 in payments made to Mr Ogunkola, and the £1,490 withdrawn in cash, £47,614.24 came from BBL funds. • Therefore, £47,614.24 of the BBL funds were not used for the economic benefit of JSL and were contrary to the terms of the BBL scheme. • JSL entered was wound up by Court Order on 31 July 2024. • At liquidation, JSL had liabilities totalling £51,247.45 of which £51,247.45 was owed to the bank in respect of the BBL.
