Conduct: Ms Wendy Fenton (“Ms Fenton”) caused Tarko Limited (“TL”) to breach the terms and conditions of the Bounce Back Loan (“BBL”) scheme by overstating its turnover in an application to obtain a BBL of £50,000 which she knew or ought to have known that TL was not entitled to receive. In that: • Under the BBL scheme rules, a company that was engaged in trading or commercial activity at the date of the application, was carrying on business on 01 March 2020 had been adversely affected by coronavirus (COVID-19) was eligible for one BBL of 25% of its 2019 calendar year turnover, with a minimum loan of £2,000 up to a maximum loan of £50,000. • TL was incorporated on 12 December 2011. Ms Fenton was appointed director on 12 December 2011 and remained as such until the TL’s liquidation on 4 April 2024. • On 30 June 2020 Ms Fenton applied for a BBL of £50,000 from a lender. On the application, Ms Fenton certified that the TL’s 2019 calendar year turnover was £250,000. The BBL was credited to TL’s bank account on 01 July 2020. • TL’s Financial Statement for the year ended 31 December 2019 and 2020 record that the Company had a turnover of £4,000 and Nil. • TL did not meet the minimum turnover requirement for the BBL scheme. To qualify for the minimum, TL needed to have a turnover of at least £8,000. The Company was not eligible for a BBL. • The BBL outstanding totals £30,184 and the bank is a creditor in the Liquidation.
