Conduct: Mark McGillvray (“Mr McGillvray”) caused SME Mechanical & Electrical Ltd (“SME”) to overstate its turnover to enable it to obtain a Bounce Back Loan (“BBL”) of £50,000 when he knew or ought to have known that the company was not entitled to a loan of that amount. Furthermore, Mr McGillvray failed to ensure the BBL funds were used for the economic benefit of SME, in that: • Under the BBL scheme, businesses could apply for a BBL of up to 25% of their 2019 turnover, from a minimum of £2,000 to a maximum of £50,000. Businesses incorporated after 01 January 2019 were asked to estimate their turnover from the date the business started. • SME was incorporated on 09 December 2011. • On 23 June 2020, Mr McGillvray applied for a £30,000 BBL on behalf of SME, declaring a company turnover of £700,000. • On 24 June 2020, SME received the £30,000 BBL funds into the company bank account. • On 17 February 2021, Mr McGillvray applied for £20,000 top-up to the BBL on behalf of SME. • On 19 February 2021, SME received the £20,000 top-up BBL funds into the company bank account. • An analysis of statements for SME’s bank account for the period from 01 January 2019 to 31 December 2019, shows the company received trading income of £40,282. Based on this turnover figure, SME was entitled to apply for a maximum BBL of £10,071 and therefore received £39,929 more than it was entitled to. • The BBL scheme required the funds to only be used to provide economic benefit to the business and not personal purposes. • Between 29 June 2020 and 30 November 2020 following receipt of the £30,000 BBL funds, £16,500 from the BBL funds was transferred to Mr McGillvray. • Between 15 March 2021 and 06 May 2021 following receipt of the £20,000 top-up BBL funds, ££13,000 from the BBL funds was transferred to Mr McGillvray. • There is no evidence provided to show that these payments were used for the economic benefit of SME. • SME entered Compulsory Liquidation on 28 April 2025 with liabilities of £57,950, which £42,880 was made up from the BBL
