Conduct: Thomas Mark Sharpe-Byrne (Mr Sharpe-Byrne) caused Cleaning & Maintenance Systems Inc Limited (“CMSIL”) to apply for a Corona Virus Business Interruption Loan (“CBIL”) of £215,000 and failed to use this to repay the existing Bounce Back Loan (“BBL”) in full as per the terms and conditions of the CBIL, in that: Mr Sharpe-Byrne applied for a BBL of £50,000 on behalf of CMSIL which was paid into CMSIL’s bank account on 11 May 2020. On 30 November 2020 Mr Sharpe-Byrne obtained a CBIL on behalf of CMSIL of £215,000 which was paid into CMSIL’s bank account on 01 December 2020. The CBIL terms and conditions required the applicant to repay any BBL held using the CBIL. Mr Sharpe-Byrne failed to do this. CMSIL entered Creditors Voluntary Liquidation on 21 November 2022. At liquidation, CMSIL had liabilities of £379,353 including £235,986.11 owing in respect of the BBL and the CBIL.
