Conduct: Marian Hobjila Mantu (“Mr Mantu”) caused HMM Driving Service Ltd (“the Company”) to obtain a Government backed Bounce Back Loan (“BBL“) which he knew or ought to have known was at least £40,999 more than the Company was eligible to receive by providing inaccurate information in relation to its turnover, in that: • The size of BBL to which an applicant was entitled under the rules of the BBL scheme was linked to turnover. Under the rules a business could apply for a BBL of up to 25% of annual turnover. Applicants trading before 01 January 2019 were required to provide a turnover figure for the 2019 calendar year; applicants that had commenced trading after 1 January 2019 were entitled to apply for a BBL of up to 25% of estimated annual turnover from the date the business started. • The Company was incorporated on 25 October 2011 and started trading on incorporation. • Mr Mantu was appointed as the sole director from 25 October 2011 to liquidation. • As the Company was trading as at 01 January 2019, the BBL application should have been based on actual turnover for the 2019 calendar year. • On 01 June 2020, Mr Mantu applied for a BBL of £50,000 stating turnover of £200,000 in the 2019 calendar year. • The Company bank account shows trading credits of 2019 in the cumulative sum of £36,002. This figure represents turnover of the Company for the calendar year of 2019. • Turnover of £36,002 would have entitled the Company to a BBL of £9,001. • The BBL Agreement was signed by Mr Mantu on 10 June 2020. • The BBL monies of £50,000 were received on 11 June 2020 into the Company bank account, £40,999 than the Company would have been entitled to. • The Statement of Affairs signed by Mr Mantu on 24 October 2023 stated the bank was owed £39,246. • The Proof of Debt submitted by the bank states the sum of £39,578.16 remains outstanding in relation to the BBL.
