Conduct: On 02 November 2020 Ms Sharon Anne Kilbane (‘Ms Kilbane’) applied for and obtained a Government-backed Bounce Back Loan (‘BBL’) of £50,000 for Kilbane Services Ltd (‘KSL’) by overstating KSL’s turnover in 2019, thereby causing it to obtain at least £39,892 in BBL funding to which it was not entitled. In that: The BBL scheme permitted a loan of up to 25% of a business’ turnover in the calendar year 2019 (or estimated annual turnover from the date it commenced trading if it had been established after 01 January 2019), to a maximum of £50,000; KSL was incorporated on 29 July 2011 and commenced trading immediately and so, therefore, it was not permitted to estimate its income for the purposes of the BBL application; On 14 April 2020 KSL filed accounts, for the year ended 31 July 2019, showing turnover of £14,700; The accounts were signed by Ms Kilbane on 12 March 2020; Bank statements for KSL’s account show trading receipts of £40,431 in the calendar year 2019; KSL was entitled to a BBL of no more than £10,108; On 02 November 2020 Ms Kilbane completed an application form for a BBL from KSL’s bank, self-certifying that its turnover in 2019 was £200,000 and requesting a loan of £50,000. The BBL was received on 03 November 2020; KSL therefore obtained at least £39,892 in BBL funding to which it was not entitled; KSL made BBL repayments of £8,372 KSL entered Creditors’ Voluntary Liquidation on 6 February 2023 At the liquidation £42,733 remained outstanding in respect of the BBL.
