Conduct: With regard to the affairs of Fast Food the following are the matters by reference to which Khalid Balaam is, in the opinion of the Secretary of State, unfit to be concerned in the management of a limited company: Khalid Balaam caused Fast Food Traders Ltd (“Fast Food”) to act in contravention of the Coronavirus Business Interruption Loan Scheme (“CBILS”) by obtaining a loan through the scheme and failing to repay monies previously borrowed through the Bounce Back Loan scheme (“BBL”) in that: • Businesses could apply for a maximum of £50,000 under the BBL scheme and other facilities were available for businesses seeking finance over £50,000 • Khalid Balaam, on behalf of Fast Food, applied for a BBL of £50,000 and on 22 May 2020 the £50,000 BBL funds were received into a bank account held by Fast Food • Through CBILS, businesses could access financial support of up to £5 million if they had been adversely affected by COVID-19 • On 8 July 2020 Khalid Balaam applied on behalf of Fast Food for a loan of £250,000 through CBILS, electronically signing a contract and confirming that he was duly authorised to do so • One of the Key Contract Terms to the CBIL, signed by Khalid Balaam states: “the borrower does not have an existing loan under the Bounce Back Loan Scheme (BBLS), the Coronavirus Large Business Scheme (CLBILS) or the Bank of England’s COVID Corporate Financing Facility (CCFF) or, if it does, this CBILS Loan will be used to repay the whole of any existing BBLS, CLBILS or CCFF loan” • On 15 July 2020 £250,000 was received into a bank account held by Fast Food • Contrary to the terms of the CBILS Key Contract Terms the BBL was not repaid, and at the date of liquidation the full amount of £50,000 borrowed under the BBL scheme remains outstanding.
