Conduct: On 02 July 2020, at a time when Fashion-Recruit Limited (“Fashion”) was not trading, David James Higson (“Mr Higson”) caused Fashion to apply for and obtain a Bounce Back Loan (“BBL”) of £50,000 that Fashion was not eligible for, by making false representations in the BBL application form, and failed to ensure that BBL funds of at least £46,760 were used for the economic benefit of Fashion, in that: • To be eligible for a BBL, Mr Higson had to declare Fashion was carrying on its business on 01 March 2020 and that it was engaged in trading or commercial activity at the date of the BBL application. Fashion would then have been entitled to apply for a BBL of between £2,000 and £50,000, up to a maximum of 25% of turnover in the calendar year 2019. • Mr Higson has stated that Fashion ceased trading in 2017. • Bank statements provided show that from 07 March 2019 to 31 December 2019 there were no receipts into the account. For 2020, there were receipts into the account totalling £143, which do not appear to represent trading income. • On 02 July 2020, Mr Higson submitted a BBL application form for Fashion, in which he declared that Fashion was carrying on its business on 01 March 2020 and was engaged in trading or commercial activity at the date of the application. • On the BBL application, Mr Higson declared turnover for the calendar year 2019 of £200,000. • Mr Higson has confirmed that turnover in 2019 would have been £0, as Fashion had not traded since 2017. With turnover of £0, Fashion would not have met the turnover requirements in order to be eligible for the minimum available BBL of £2,000. • Between 03 July 2020 and 19 October 2020, Mr Higson transferred at least £46,760 of the BBL funds to himself, and he has confirmed that these were used for his own personal benefit and not for the economic benefit of Fashion. • At the date of liquidation, the BBL lender was owed £50,000.
