Conduct: Diane Wesa-Budd (“Ms Wesa-Budd”) caused Kuona Limited (“Kuona”) to provide inaccurate information regarding its turnover in an application to obtain a Government-backed Bounce Back Loan (“BBL”) of £50,000. As a result, Kuona received more in BBL funds than it was entitled to. Furthermore, the BBL funds were not used in their entirety for the economic benefit of Kuona: • Under the BBL scheme businesses affected by the Coronavirus pandemic could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure required was that for the calendar year 2019 or where a business was established after 1 January 2019 it is their estimated annual turnover from the date the business started. • Kuona was incorporated on 19 January 2011 and commenced trading in the same year. • Ms Wesa-Budd states that on 08 March 2021 a third party applied for a BBL of £50,000 on behalf of Kuona, stating Kuona’s turnover to be £200,000. • Full accounts provided by the company accountant show turnover for the year ending 31 March 2019 of Nil and for the year ending 31 March 2020 of £25,436. • The balance in Kuona’s bank account was £10.67 prior to the receipt of the BBL and £50,000 was credited into Kuona’s bank account on 09 March 2021. • From 10 March 2021 to 11 March 2021, seven payments totalling £45,368.71 were paid out of Kuona’s bank account of which at least £45,358.04 must have come from BBL funds. No evidence has been provided that these payments were for the economic benefit of Kuona. • At Liquidation Kuona Ltd had debts of £102,068.74 of which £49,878.85 related to the BBL.
