Conduct: On 30 November 2020, following the presentation of a winding up petition on 08 April 2020 and a winding up order being made by the Court on 04 August 2020, Mr Antony Macken (“Mr Macken”), disposed of an asset of TMAK Construction Limited (“TMAK”) and failed to disclose the asset, or its subsequent disposal or the net sale proceeds of £48,189 to TMAK’s various liquidators, in so far as; • On 07 October 2018 TMAK purchased an A.B.I Tribeca static caravan (“the Lodge”) with a finance agreement in TMAK’s name. • On 08 April 2020 a winding up petition was presented at the High Court of Justice Business and Property Courts in Birmingham and Mr Macken was aware of the petition. • On 20 July 2020, TMAK was advised that assets should not be disposed of after the date of the petition. • On 04 August 2020 a winding up order was made at the High Court of Justice Business and Property Courts in Birmingham. • Mr Macken failed to disclose the Lodge as an asset of TMAK within the Preliminary Information Questionnaire company (PIQC) to the Official Receiver (acting as Liquidator) at the outset of the liquidation on 21 August 2020. • Further, Mr Macken did not disclose the Lodge to the Official Receiver during a telephone interview on 03 September 2020 • On 30 November 2020, Mr Macken caused the Lodge to be sold to a third party, resulting in net proceeds of £48,189 after settlement of the then outstanding finance. The net proceeds were placed into a bank account not associated with TMAK and not given to the Liquidator(s) of TMAK. • The sale of the Lodge and net sale proceeds were not disclosed to or given up to any of the Joint Liquidators appointed in place of the Official Receiver
