Conduct: Ching Yu (“Mrs Yu”) caused or allowed Kai Hing Limited (trading as You & Yu Restaurant) (“Kai Hing”) to fail to declare cash takings to HMRC from appointment as a director on 18th April 2013 until a HMRC inspection took place at the company premises on 19th November 2015:

  • Following a review of Kai Hing’s VAT return for VAT quarter ended 31 January 2014 HMRC discovered discrepancies between the filed return and till takings data extracted from the business.
  • As a consequence HMRC raised assessments of £149,329 in VAT and £233,170 (including penalties and S455 liability) in Corporation Tax relating to the VAT quarters October 2011 to January 2016 inclusive.
  • The VAT assessment for quarters October 2011 to January 2016 was based on a comparison of information extracted from Kai Hing’s EPOS till records and the submitted VAT returns.
  • HMRC discovered £611,741 of additional sales recorded by the EPOS system which gave rise to an increased VAT liability of £119,291 for the VAT quarters October 2011 to January 2016.
  • Kai Hing made no payments towards the balance of the increased liability but did continue to trade until January 2017 whilst submitting quarterly returns and paying them in full. Apportioning the assessed liabilities for the period during which she was in office results in a combined VAT, Corporation Tax and S455 liability of £225,826.
